1. Introduction

Contract Acceptance

By accessing and using Tree Hugger Travel’s website (https://www.treehuggertravel.com.au) or any affiliated domain names, you agree to be legally bound by the following Terms and Conditions, which shall take effect immediately. If you do not agree to be bound by these Terms and Conditions, please refrain from accessing and using the website. The person making the booking shall be deemed to have accepted these Terms and Conditions on behalf of all other persons named in the booking who will participate in the booked tours.

Definitions of Key Terms

  • Customer: The person making the booking.
  • Booking: The booking of a Tour, Accommodation, Vehicle Rental, or Package by you via Tree Hugger Travel (website https://www.treehuggertravel.com.au), which is deemed accepted upon your payment of the Quote price minus any Taxes, Levies, or Fees that are payable directly to the Tour Operator, Accommodation Provider, or Vehicle Rental Company.
  • Quote: The total Price of the Tour, Accommodation, Vehicle Rental, or Package, including Taxes, Levies, and Fees.
  • Price: The cost of the Tour, Accommodation, Vehicle Rental, or Package, including Taxes, Levies, and Fees.
  • Taxes: Any applicable taxes, including GST, tourist, or other visitor taxes that apply to the Tour, Accommodation, Vehicle Rental, or Package.
  • Levies: External costs set by the Tour Operator, Accommodation Provider, or Vehicle Rental Company, such as fuel surcharges.
  • Fees: External costs set by the Tour Operator, Accommodation Provider, or Vehicle Rental Company, such as national park fees or marine park fees.
  • Operator Cancellation and Refund Policy: The terms and conditions set by the Tour Operator, Accommodation Provider, or Vehicle Rental Company that deal with cancellations, refunds, and related matters in relation to a Booking.
  • Travel Credit: Credit from a previous Booking, the value of which can be redeemed on Tour, Accommodation, Vehicle Rental, or Packages offered by Tree Hugger Travel (website https://www.treehuggertravel.com.au), minus any Levies or Fees.
  • Administration Fee: A fee charged by Tree Hugger Travel (website https://www.treehuggertravel.com.au) covering any costs incurred for its Services.
  • Services: Consultation, agency work, itinerary planning, travel advice, and any effort that is served to the customer by Tree Hugger Travel (website https://www.treehuggertravel.com.au) and its employees.

2. Our Service

Itinerary Building and Planning

Tree Hugger Travel offers comprehensive itinerary building and planning services for clients seeking personalised travel experiences. Our expert team will work closely with you to create a customised itinerary that aligns with your preferences, interests, and travel requirements. Please note that while we make every effort to plan and provide accurate information, itinerary details, such as costs, dates, and times, are subject to change, and we recommend using the information as a guide during your travel selection.

Tree Hugger Travel as an Intermediary

Tree Hugger Travel aims to provide accurate and up-to-date information on costs, dates, and times of tours, accommodations, and vehicle rentals listed on our website. However, please note that this information is subject to change. While we make efforts to update the information promptly, we cannot guarantee its accuracy. Therefore, we recommend using the information as a guide when making your selection.

Tour Operators, Accommodation Providers, and Vehicle Rental Companies

We strive to select and package tours, accommodations, and vehicle rentals that meet your expectations. However, we do not assume responsibility for any matters that may arise during individual tours or arrangements with specific Tour Operators. We value your feedback, including complaints, compliments, or suggestions, but we cannot be held liable for any loss, expense, or damage you may incur during such tours or travels. These matters are the sole responsibility of each individual Tour Operator, Accommodation Provider, or Vehicle Rental Company, and you agree not to hold us liable in any such circumstance.

3. Cancellations, Amendments, and Refunds

Cancellation by the Customer

If you are unable to participate in a booked Tour, check-in to Accommodation, or pick up a Vehicle Rental on the scheduled date and time, please contact the respective Tour Operator, Accommodation Provider, or Vehicle Rental Company as early as possible. Refunds for tours, accommodations, or vehicle rentals will be subject to the individual policies of the respective operators. You agree that, notwithstanding any cancellation or refund policy of the Tour Operator, Accommodation Provider, or Vehicle Rental Company, all refunds will be liable to a 6% administration fee.

Cancellation by the Tour Operator (excluding weather)

In some cases, a Tour Operator, Accommodation Provider, or Vehicle Rental Company may make alterations to tour dates, prices, inclusions, itineraries, minimum numbers, age restrictions, etc. Tree Hugger Travel reserves the right to cancel, change, transfer, or substitute any booked tour at any time and for any reason. If you choose not to accept the alternatives offered, you will be entitled to a full refund. However, if we receive advance notice of a significant change to a tour, we will make reasonable efforts to communicate this to you and facilitate an amendment of the booking. Please note that any credit card processing fees incurred during the booking process are non-refundable.

Cancellation due to Weather

If the Tour, Accommodation, or Vehicle Rental you have booked is unable to be taken because of weather, it may be rescheduled. You, the Customer, should make contact with the Tour Operator prior to the date and time of travel using the contact details provided on your booking confirmation to organise this. The Tour Operator will do all possible to reschedule the Tour, Accommodation, or Vehicle Rental to a date and time suitable for you, the Customer. If the rescheduled date is not suitable, you may be entitled to a refund. However, you agree that, notwithstanding any cancellation or refund policy of the Tour Operator, Accommodation Provider, or Vehicle Rental Company, any credit card processing fees incurred during the booking process are non-refundable.

Credit Card Fees, Bank Fees, and Exchange Rates

In some instances, bank fees and exchange rates may result in a refunded amount different from the original payment, particularly when currency exchange and credit or debit card payment is involved. Tree Hugger Travel has no control over bank fees or exchange rates and cannot accept responsibility for any discrepancies in refunded amounts.

General Refund Process Administration Fee

Tree Hugger Travel will charge a 6% Administration Fee to all refunds made unless otherwise stated on the travel vouchers. This fee is waived where the Customer opts for Travel Credit, which can be used to up the value of the cancelled Tour, Accommodation, Vehicle Rental, or Package for future Bookings. This fee covers all un-recoverable costs incurred by Tree Hugger Travel that include payment processing fees and third-party booking fees.

4. Booking Confirmations and Your Responsibilities

Open Dated Tickets

For open-dated tickets, it is your responsibility to book your travel dates in advance with the individual Tour Operator, Accommodation Provider, or Vehicle Rental Company, as indicated on your voucher.

Tickets with Booked Dates

It is your responsibility to redeem your tickets on the booked dates. If you wish to change these dates, you must communicate directly with the Tour Operator, Accommodation Provider, or Vehicle Rental Company, providing adequate notice. All booked dates should be reconfirmed 48 hours prior to travel (minimum guide only) or as specified on your voucher. If applicable, dietary requirements should also be confirmed at this time.

5. Travel Insurance

We strongly recommend that all travellers purchase travel insurance to cover any liability that may be incurred to us or a Service Provider, as well as other travel misadventures you wish to be insured against. It is your personal responsibility to obtain suitable travel insurance with a low excess payment to facilitate claiming on cancelled tours.

6. Passports and Visas

It is your responsibility to ensure that you possess valid passports, visas, and re-entry permits that meet the requirements of immigration and other government authorities. Any fines, penalties, payments, or expenditures incurred due to inadequate travel documentation will be your sole responsibility. Please note that all travellers must have a valid passport for international travel, and many countries require at least six months’ validity from the date of return.

  • Third Party Material: Content, data, information, applications, services, websites, and materials from, incorporating, linked, or connected to third parties (including our partners, affiliates, and related service providers).
  • Malicious Computer Program: Files that consist of malicious computer programs, including viruses, Trojan horses, worms, or any other computer programming that may damage, modify, delete, detrimentally interfere with, access without authority or expropriate any system, data, or personal information; that may cause damage to the Website or Social Media, content on either, our property or the property of other individuals or organisations.
  • Indigenous Cultural and Intellectual Property (ICIP): Australian Aboriginal and Torres Strait Islander peoples’ rights to their heritage, comprising all objects, sites, and knowledge, including language, the nature or use of which has been transmitted or continues to be transmitted from generation to generation, and which is regarded as pertaining to a particular Aboriginal or Torres Strait Islander group or its territory.
  • Intellectual Property (IP): Copyright, patents, registered and unregistered trademarks, registered designs, trade secrets and know-how, confidential information, all rights under any legislation relating to the protection of computer programs, circuit layouts, and all other intellectual property as defined by Article 2 of the ‘Convention Establishing the World Intellectual Property Organisation’ dated July 1967.
  • Tour Operator: A company that designs and conducts travel packages and tours, providing comprehensive travel experiences to customers.
  • Accommodation Provider: A business that offers lodging services, providing temporary accommodation options for travellers.
  • Vehicle Rental Company: A company that offers temporary access to vehicles, allowing travellers to have transportation during their trips without owning a vehicle.

9. Acceptance of Terms and Conditions

Use of Tree Hugger Travel (https://www.treehuggertravel.com.au) is entirely at your own risk. You must only use Tree Hugger Travel in accordance with these Terms and any applicable law. You should immediately cease using our website and services if you do not agree to these Terms. These Terms also govern updates, upgrades, and new and amended versions of Tree Hugger Travel (https://www.treehuggertravel.com.au), unless such versions are accompanied by new terms for use, which will govern those versions.
